Term and Service
Please note that this agreement is subjected to change and it is Customer’s responsibility to regularly check for modifications. Continued use of the Service constitutes acceptance to the new version of this agreement.
Macdome reserves the right to refuse or terminate service to anyone, at any time and for any reason, including but not limited to violation of Macdome Acceptable Use Policy. Should Macdome terminates Customer’s service for a reason other than violation of the Acceptable Use Policy, Macdome will issue Customer a refund for the remaining paid period of service. Under no circumstances is Macdome responsible for any damages resulting from termination of service. Macdome reserves the right to refuse service to particular individuals or entities, at its sole discretion, with or without cause.
Macdome has the right to cancel products and services without refund for orders pending due to insufficient information and/or documents supplied. All information & document(s) shall be submitted to Macdome within 90 days from purchase date, any failure to do so will result in the cancelation of the service/product.
1. User Responsibilities
You are required to provide accurate, complete, and current information during the registration process. It is your responsibility to keep your account details updated, including email and billing information. Providing false or misleading information may result in account suspension or termination.
2. Content
All services provided by Macdome may only be used for lawful purposes. The laws of Malaysia apply. The customer agrees to indemnify and hold harmless Macdome from any claims resulting from the use of our services.
3. Price Protection
The amount customer pay for hosting will never increase from the date of purchase unless there are certain terms involved such as a first year promotion etc. Macdome reserve the right to change any packages or prices listed in our website and has the right to adjust the amount of resources given to the packages at any time. Should the Customer request to upgrade the features of the subscribed package, there will be an upgrade fee incurred.
4. Price Contract
All services will have 1 year price contract. This means the price will be fixed for a period of 1 year regardless of whether the customer is paying monthly, quarterly or half year. In the event the customer request for a price adjustment, a contract breaking fees MYR130.00 will be imposed.
5. Delivery
Delivery periods can only be estimated. Exceeding the delivery time never entitles Customer to be paid damages or cancellation of the order. Should the delay is due to a reason within Macdome itself such as Macdome is temporarily or permanently unable to fulfill the order partially or completely, Macdome reserves the right to partially or completely cancel or decline the order. Macdome also reserves the right to deliver the order with a similar specifications or higher. Macdome will notify CUSTOMER of such decisions. Once the service is delivered, it is the customer’s responsibility to check and report back within 7 days for any discrepancies or related problems. Macdome will take the effort to rectify the problem including reinstall or replace the entire server without any charges. However if the report is made after 7 days, there will be a charge for any services rendered.
6. Payment
All sales are final. Macdome will charge or debit your payment method at the beginning of your subscription. Billing will continue according to the cycle stated at the time of your order. All subscription plans are renewed automatically until cancellation. You may cancel at any time during your subscription.
7. Suspension
Payments are generally due immediately at the time of subscription to activate the service, and Macdome dispatches e-mail invoices prior to the payment due date. Emails are issued as a courtesy; Customer will maintain awareness of its usage levels and the fees it owes Macdome and the due date. Macdome will not accept the reason of late payment or no payment due to email not received. If payment is not received by next billing cycle, Customer’s account will be suspended. If the account is suspended for over ten (10) calendar days, there may be a MYR350.00 setup fees whereby Macdome need to resetup an entire server for the Customer. Accounts may be deleted if they have spent ten (10) or more calendar days in a suspended state. Any discrepancy or dispute in invoice or payment made must be reported to Macdome within 30 days after payment is made. Macdome will not accept any dispute in payment made after 30 days.
8. Customer Data
Macdome will never sell or disclose Customer’s contact information, data or Customer lists to any third party, unless required by law or specifically authorised by Customer.
9. Customer Support
Macdome provides Customer support and is committed to provide the best possible support for all Customers. For any service request not subscribed by the Customer, Macdome reserves the right to charge MYR130/hr for any troubleshooting issues. Macdome at its sole discretion reserves the right to deny providing services requested by the Customer with or without reasons. For any services rendered, charged or not charged, Macdome provides the best effort services. Macdome will not be held responsible for any other issues that resulted directly or indirectly due to the support given. Should there be incident whereby Macdome provides FREE support to the Customer, this is a courtesy service and cannot be defined as evidence that Macdome must commit to provide FREE support to the Customer. In this case, Macdome reserves the right to stop providing courtesy service to the Customer at any time.
10. Refund Policy
- The service for which you are requesting a refund was ordered within the past 7 days, and only applies to the first service of a new client.
- Refunds will not be granted for accidental or incorrect purchases. Customers are advised to carefully review their orders before completing the transaction.
- Additional orders are not eligible for a refund
- Services that are suspended or terminated due to non-compliance of the AUP and TOS are not eligible for refunds.
- Your account with us is in good standing, meaning there are no outstanding amounts due and no violations of our Terms of Service.
- None of your payments to us have been previously disputed or charged back, and are not currently under dispute or chargeback.
- Special discounted services/products are not eligible for refunds. Promotional item or when promotional code used, is not eligible for a refund.
- Refunds and money-back guarantees are available only for purchases made via PayPal, while for other payment methods are not eligible for a refund.
- Refunds are strictly limited to the first purchase only, and no refunds will be provided for subsequent purchases.
- All setup fees and additional add-ons selected during the purchase process are non-refundable under any circumstances.
- Refund will exclude any processing fee such as a payment gateway fee/transaction fee, these fees will be deducted from the refundable amount.
- Refunds for successful cancellations will take 3-5 working days to be credited back to your PayPal account, and we kindly ask for your patience as the refund process may take some time to complete.
Once a refund request is made and all the conditions outlined above have been met, the following actions will be taken:
- A full refund of payments made towards the account will be issued, starting from the account creation date, excluding licenses, management services, administrative fees, setup fees or custom order fees that may have been incurred during the purchase process.
- All services under the account will be terminated immediately.
- All data, backups, and snapshots associated with the account will be permanently and irreversibly deleted without delay.
11. Cancellation
Users may cancel their subscriptions at any time through their account settings. Cancellation requests must be submitted before the next billing cycle to avoid charges for the subsequent period. Access to services will remain active until the end of the current billing cycle.
12. Acceptable Use Policy
Customer asserts that it has read Macdome Acceptable Use Policy (“AUP”) and its Privacy Policy. Customer will adhere to the AUP and Privacy Policies and will not allow the Services or Macdome equipment to be used for activities prohibited by such policies. Macdome may revise the AUP from time to time by posting a new version thereof on the Macdome Website, and Customer is responsible for awareness of such revisions. In the event of any conflict between the AUP or the Privacy Policy and this Agreement, this Agreement will govern. Macdome may impose a penalty fees to the Customer if the AUP is broken.
13. Warranty
Macdome services are provided on an “as is” and “as available” basis. Macdome does not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components. Macdome makes no express or implied warranties, including without limitation warranties of title, non infringement, merchantability, or fitness for a particular purpose. No advice provided by Macdome or any of its representatives will create a warranty.
14. Disclaimer
Macdome will not be liable for any consequential, incidental, exemplary, punitive, or multiple damages, even if Macdome was advised in advance of the possibility of such damages. Macdome maximum liability arising out of or related to provision of its services will not exceed the total amount of fees billed to Customer during the twelve (12) months preceding the claim.
Macdome will have no liability whatsoever for any claims, losses, actions, damages, suits, or proceedings resulting from:
1. other Macdome Customers or third parties accessing Customer’s data or assigned computers
2. security breaches
3. eavesdropping
4. denial of service attacks
5. interception of traffic sent or received using Macdome service
6. Customer’s reliance on or use of the service
7. mistakes, omissions, interruptions, deletions of files, errors, defects, delays in operation, or other failures of performance of the service
8. the accuracy, completeness, and usefulness of the service; or
9. loss of data or loss of access to data
Macdome limitations and exclusions of liability apply equally to Macdome officers, employees, agents, contractors, representatives, suppliers, subsidiaries, parents, and affiliated companies.
15. Chargebacks & Dispute
Macdome takes chargebacks very seriously. If a chargeback is initiated, the associated account and all related services will be immediately terminated without prior notice.
To request account reinstatement, please email support@macdome.com with the subject line “Chargeback Account Restoration”. A penalty may apply depending on the circumstances.
Macdome also reserves the right to access your data if requested by our payment processing partner. This data may be used as evidence and for further investigation to ensure the dispute is resolved fairly and prompt
